Terms of Service

1. Using ScaleBooth

You must provide accurate account information, keep your credentials secure and use the service only in accordance with applicable law and these Terms. You are responsible for activity performed through your account and for the people you authorize to use it.

2. The ScaleBooth service

ScaleBooth provides an AI-powered conversion platform that can answer enquiries, use business-specific knowledge, qualify leads, recommend products or services, book appointments, hand conversations to humans and trigger configured business actions. Available capabilities depend on your plan, configuration, integrations and third-party provider availability.

ScaleBooth may change or improve the service over time. We may add, modify or discontinue features where reasonably necessary for product development, security, legal compliance or third-party platform changes.

3. Your business knowledge and content

You retain ownership of the business information, documents and other content you provide to ScaleBooth. You grant ScaleBooth the limited rights necessary to host, process, transform, retrieve and transmit that content for the purpose of providing the service.

You represent that you have the rights and permissions needed to provide that content and any customer data processed through your account.

4. AI behavior, accuracy and guardrails

ScaleBooth is designed to use your configured business knowledge together with built-in conversion methodology and platform guardrails. AI systems can still produce incorrect, incomplete or unexpected outputs. You are responsible for reviewing your business knowledge, configuring approvals and restrictions appropriately, and monitoring use of the service for your business.

ScaleBooth is not a substitute for legal, medical, financial or other regulated professional advice. You should not configure the agent to make decisions that legally require a licensed professional or human judgment unless you have implemented appropriate review and controls.

5. Acceptable use

You may not use ScaleBooth to violate law, infringe rights, distribute malware, conduct fraud, impersonate others, bypass platform security, send unlawful or abusive communications, or process information you are not authorized to use. We may suspend or restrict accounts when reasonably necessary to protect users, third parties or the service.

6. Third-party channels and integrations

ScaleBooth can connect with third-party services. Those services are controlled by their respective providers and may impose separate terms, permissions, fees, limits or approval requirements. We are not responsible for outages, policy changes or actions by third-party services outside ScaleBooth's reasonable control.

7. Plans, billing and Lemon Squeezy

Paid ScaleBooth plans may be sold through Lemon Squeezy. For purchases processed through Lemon Squeezy, Lemon Squeezy acts as the reseller and Merchant of Record and handles the payment transaction, applicable tax/VAT, payment compliance, refunds and chargebacks.

Your checkout may also be subject to Lemon Squeezy's buyer terms. Subscription price, billing interval and included usage are shown before purchase. Unless otherwise stated, subscriptions renew automatically until cancelled.

Cancellation stops future renewal; it does not automatically refund a charge already processed. Refund eligibility is described in our Refund Policy.

8. ScaleBooth intellectual property

ScaleBooth retains all rights in the platform, software, interfaces, agent methodologies, playbooks, workflows, prompts and orchestration logic, guardrails, analytics, designs, trademarks and other technology created by or for ScaleBooth. These Terms do not transfer ownership of ScaleBooth intellectual property to you.

9. Service availability

We work to provide a reliable service but do not promise uninterrupted or error-free availability. Maintenance, security incidents, internet failures, model-provider issues and third-party platform outages may affect operation.

10. Disclaimers

To the extent permitted by law, ScaleBooth is provided on an “as available” basis. We do not guarantee a particular number of leads, bookings, sales, revenue or other business result. Marketing and conversion performance depends on factors outside the platform, including your offer, pricing, market, traffic, business knowledge and customer demand.

11. Limitation of liability

To the maximum extent permitted by applicable law, ScaleBooth will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data arising from use of the service. Any mandatory rights that cannot legally be excluded remain unaffected.

12. Termination

You may stop using ScaleBooth and cancel a paid subscription subject to the applicable billing terms. We may suspend or terminate access for material breach, unlawful use, security risk, non-payment or where continuing to provide the service would violate law or third-party platform requirements.

13. Changes to these Terms

We may update these Terms to reflect changes to ScaleBooth, our providers or applicable requirements. Material changes will be communicated where required. Continued use after an updated version becomes effective constitutes acceptance to the extent permitted by law.
